Terms and Conditions

CREATIVE LADS Studio provides deliverables “Services” as listed on our website www.creativelads.com.au according to the following Terms and Conditions. Please read these Terms and Conditions as stated below before you order. In ordering any of the “Services” from the Site you agree to be bound by these Terms and Conditions. We also encourage you to check from time to time for any updates.

1. Ordering Process

Ordering should all be done online through our website or any of our affiliate pages and sites. Payment for services that you order should be completed/made before your order is placed on cue for creation and delivery. It is a condition of your use of this Site that all provided information should be, current, and complete. If CREATIVE LADS believes the information provided is not correct, current, or complete, we have the right to refuse you access to any of its resources and services, without notice. Upon completion of payment of a particular service(s), the contract for that particular project is immediately in effect.
Where it states additional services are included FREE of charge in some of our packages, it falls under special terms, example: If free hosting service is offered or a percentage of the hosting is discounted this is only available if you order the complete package, as for graphic designing packages most offer free additional services such as icon, business card design and a letterhead design, these extras are free ONLY if you choose to print with us and only available prior to completion of your ordered project, if you agree to print with us then you are required to purchase the Printing Package before requesting the free designs / services.
However if printing services are temporarily unavailable CREATIVE LADS can offer to provide you with all or some of the free designs mentioned in your package, To learn more about this please email us prior to placing your order.

2. Delivery Time

Please note that the counting of the delivery time starts only once the payment has been made on an order, and not on the date the “Service” is ordered.

3. Policy on Requesting Revision or a Complete Redesign

When a redesign is requested. It is a must that for a client to provide a clear evaluation of initially delivered concepts, that can be a basis for the next set of designs to be done. CREATIVE LADS reserves the right to decline a request for multiple re-designs if the client does not seem to be giving enough information on how to go about the next set. With regards to revisions, CREATIVE LADS will revise accordingly as needed and requested by the client as long as requests are within reasonable bounds.

4. Cancellation and Refund

Orders can be cancelled anytime before the delivery of the initial concepts. If you wish to cancel your order you must give us clear written instructions through email. In the email, the subject line should say “ORDER CANCELLATION”. If the order is cancelled before the delivery of the initial concepts, there may still be charges depending on the scope of work done to date. If applicable, we will refund to the card with which you made payment any over payment you may have already made. Because the work we do is custom to your specifications, refunds are only given under rare circumstances with the written approval of Executive Management. We cannot cancel your order if you are unable to provide us with proof of purchase or if we believe that that you have made use of the Service(s).

5. Events Outside Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of your website due to hosting service, Even if the hosting services are provided through us, this includes but not limited to email hosting. any of our obligations under a contract that is caused by events outside our reasonable control (“Hacking and or force-downing of your website”). A special event where the internet and or the hosting service is cut-off includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following: (a) lock-outs or other industrial action. (b) Civil commotion, Your server and or our office being under (c) Fire, explosion, storm, floor, earthquake, subsidence, epidemic or other natural disaster. (d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means which result in the delay and or suspension of your services. (e) Impossibility of the use of public or private telecommunications networks. (f) The artwork provided by us (Creative Lads) to you (customer) turns out somehow similar to another competitor who is in the process of or planing to sue you, where you face legal action or forced to no longer use the artwork provided to you, thin this case no compensation and or refund will be offered to you, it is your responsibility to trademark your artwork once completed and check wether the idea of your artwork is protected by another company before you place your order, we are in no way responsible or can be asked for losses and or compensation, it is as simple as: you give us an idea and we design it for you!, some of our designers might use your ideas or their ideas and or sources to create an artwork similar to a competitor (unknowingly) in that case Creative Lads can only revise the artwork once provided that evidence and a written letter including a copy of a complaint and proof that Creative Lads is actually responsible for the mistake (this however can only be brought forward within the first 2 weeks of completion of the design, any complaints 2 weeks after the completion of the design will not be re-designed free of charge nor will Creative Lads can be held responsible even if the initial mistake was made by one of our team members (g) The acts, decrees, legislation, regulations or restrictions of any government. Our performance under any contract is deemed to be suspended for the period that the Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavors to bring the Event to a close or to find a solution by which our obligations under the contract may be performed despite the Event.

6. Disclaimer

The materials on CREATIVE LADS web site are provided “as is”. CREATIVE LADS makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, CREATIVE LADS does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

7. Limitations

In no event shall CREATIVE LADS or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on CREATIVE LADS Internet site.

CREATIVE LADS may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.
